On June 10, 2022, we had an Online Basic Orientation at Maligaya House.
7 participants joined the event. They are from:
* Malabon,
* Lian, Batangas,
* Quezon City,
* Meycauayan, Bulacan,
One case was a JFC with Japanese nationality who came to Maligaya House for advice on how to get in touch with her Japanese brothers and sisters in Japan. After talking to her, we learned that her Japanese father had already died 13 years earlier. Under Japanese law, the deadline for filing a lawsuit is within 3 years after his death, and after 3 years, she cannot claim recognition. In her case, she will not meet the deadline for filing a posthumous recognition case, but she participated in an online orientation to make sure she understood our support and her rights as a JFC.
Recently, we have been receiving inquiries about their Japanese father’s whereabouts more than 3 years after they had already passed away. After trying all possible means to find their father, but being unable to locate them, they finally reached Maligaya House and RGS-COW, and after having their father’s whereabouts located by the JFC network, they often find out that their father had already passed away more than 3 years ago. It is very difficult to locate and contact their father while they are in the Philippines. With the increase in international marriages and the diversification of family forms, there is no rational reason to set a three-year time limit for filing a posthumous recognition case, assuming that there are children within Japan.
Currently, the JFC Network is accepting consultations even in cases where three years of postmortem recognition have passed.
As of now, two cases are accepted at RGS-COW in Davao and one at Maligaya House, two of which are ongoing lawsuits against the 3-year time limit for filing a posthumous recognition.
