たくさんの課題を抱えたまま年が明けましたが、今年もJFCを取り巻く問題に一つひとつ丁寧に取り組んでまいります。

どうぞ皆様、引き続きご支援・ご協力をよろしくお願い申し上げます。

＜抱えている課題＞

・日本弁護士連合会の法律援助の問題（在外ケースの成人認知請求事件の援助申請が許可されなくなっている問題）

・いわゆる「JFC査証」の問題（在フィリピン日本大使館・領事館において「日本人との間の実子を同伴して渡航するフィリピン人親の査証」を直接に申請できるが不許可率が非常に高い問題）

・離婚届不受理届の在外大使館・領事館での受理を可能とすること

・戸籍に記載される外国籍の配偶者や子の名前をアルファベット表記を併記すること。（年末、日本人の父の代理人弁護士から、日本にいる子宛てに「フィリピンにいるあなたの母に対して離婚訴訟を起こしたいが、戸籍にはカタカナしか書いてないため、正式なアルファベット表記の名前と住所を教えて欲しい」と連絡がありました。日本人側からしても配偶者や子の本国での名前の表記が分からないと困るわけですね）

・国籍法12条で日本国籍を喪失した子について、父の戸籍へ記載すること。（昨年、ある自治体で、国籍喪失したJFCが父の戸籍を取得しようとしたところ「拒否」された件がありました。）

The new year has arrived with many issues still pending, but we will continue to tackle each problem surrounding JFC one by one with great care.

＜Current Challenges＞

・Legal aid issues with the Japan Federation of Bar Associations (JFA) (The problem that applications for legal aid in adult recognition cases involving overseas cases are increasingly being denied)

・The so-called “JFC Visa” issue (The problem that while it is possible to apply directly at the Japanese Embassy or Consulate in the Philippines for a “visa for a Filipino parent traveling with a biological child born to a Japanese national,” the denial rate is extremely high)

・Enabling the acceptance of divorce non-acceptance notifications at overseas embassies and consulates

・Requiring the recording of foreign-national spouses’ and children’s names in the family register using both katakana and alphabetical notation. (Late last year, a lawyer representing a Japanese father contacted us regarding a child residing in Japan, stating: “he plans to file for divorce against your mother in the Philippines, but the family register only lists her name in katakana. Please provide her official alphabetical name and address.” It’s problematic for the Japanese side too when they don’t know the name of the spouse or child in their home country.)

・Enable the registration of children who lost Japanese nationality under Article 12 of the Nationality Act into their father’s family register. (Last year, there was a case where a JFC (Japanese-Filipino child) who lost nationality was “refused” when trying to obtain their father’s family register at a local government office.)
